Please read these General Terms of Use (hereinafter, the “General Terms”) carefully before using the website (hereinafter, the “SITE”) owned by TUNA JEWEL PROJECT, including its affiliated, subsidiary, and related companies, or any entities under its direct or indirect control (collectively referred to as “TUNA JEWEL PROJECT”), as well as any materials contained on or linked to the Site.
By continuing to use the Site and/or by accessing the Site electronically or through other means, you (hereinafter, the “Client”) acknowledge that you have read and agree to these General Terms.
TUNA JEWEL PROJECT reserves the right to update or revise these General Terms at any time without prior notice. Please review these General Terms periodically to stay informed of any changes. Continued use of the Site following any changes constitutes your acceptance of those changes.
1. PURPOSE
Through this Site, TUNA JEWEL PROJECT sells jewelry and/or other creative products made by Tuna Jewel Project.
2. INTELLECTUAL PROPERTY
The Client acknowledges that all content—including but not limited to text, data, product renders, photographs, videos, graphics, or other materials—accessible through the Site is protected by copyright, trademarks, service marks, patents, trade secrets, data rights, publicity or privacy rights, or other intellectual property laws and rights.
Unless expressly authorized, you may not sell, lease, modify, copy, republish, transfer, electronically download, display, disclose, transmit, or distribute any content from the Site in any way.
3. PRODUCT AVAILABILITY
All products offered on the Site are subject to stock and availability. Delivery times may vary and will be communicated to the Client, or the order may be canceled and charges refunded if necessary.
4. SHIPPING COSTS AND PRODUCT DELIVERY
TUNA JEWEL PROJECT will ship products to the address provided by the Client, as long as it falls within the coverage area communicated by the company.
Delivery time begins once payment has been confirmed through the website.
Products are shipped and delivered by third-party logistics companies (hereinafter, “Shipping Companies”). Therefore, the Client agrees to be subject to the delivery policies of these Shipping Companies, which are incorporated by reference into these General Terms of Use.
The delivery time shown on the Site is an estimate and may change due to logistical or force majeure reasons. In the event of delays caused by force majeure or unforeseen circumstances, TUNA JEWEL PROJECT shall not be held liable.
If the Client does not receive the products within the estimated timeframe, they must contact TUNA JEWEL PROJECT’s customer service center to check the status of the order.
Shipping costs within the Mexican Republic are covered by TUNA JEWEL PROJECT and will be disclosed to the Client prior to purchase confirmation.
5. CLIENT RESPONSIBILITY FOR TRANSACTIONS
The Client assumes full responsibility for any costs, taxes, fees, and claims arising from the use of this website.
6. LIMITATION OF LIABILITY
Information on the Site is not guaranteed to be accurate and may contain technical or design-related inaccuracies.
TUNA JEWEL PROJECT will make reasonable efforts to update the content regularly but is not obligated to do so.
TUNA JEWEL PROJECT does not guarantee that the Site will meet the Client's expectations or that it will remain uninterrupted, timely, or error-free.
Under no circumstances shall TUNA JEWEL PROJECT be held liable for any damages, losses, expenses, or system or line failures, whether direct or indirect.
7. INDEMNIFICATION
The Client agrees to indemnify and hold harmless TUNA JEWEL PROJECT from any claims, actions, or demands (including legal fees and court costs) arising from:
(i) misuse of the Site or its content,
(ii) libel, defamation, or other violations committed by the Client while using the Site,
(iii) infringement of copyright or other intellectual property laws or treaties, or
(iv) unauthorized use of the Site by any third party accessing it using the Client’s name or banking information.
8. ILLEGAL OR PROHIBITED USE
Using the Site for any illegal purposes or for any use not authorized by these General Terms is strictly prohibited.
9. GOVERNING LAW AND JURISDICTION
By using the Site, the Client expressly agrees to submit to the jurisdiction of the courts located in Guadalajara, Jalisco, Mexico, and to the applicable substantive and procedural laws in force in that jurisdiction.
The Client expressly waives any other jurisdiction that might correspond to them by reason of nationality, residence, or place of business, now or in the future, for the resolution of any dispute related to the interpretation, fulfillment, or enforcement of these General Terms.
